1.Article 145 Whoever produces medical apparatus and instruments or medical hygiene materials that are not up to the national or trade standards for safeguarding human health or sells such things while clearly knowing the fact, thereby causing serious harm to human health, shall be sentenced to fixed-term imprisonment of not more than five years and shall also be fined not less than half but not more than two times the amount of earnings from sales; if the consequences are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined not less than half but not more than two times the amount of earnings from sales; if the circumstances are especially flagrant, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than half but not more than two times the amount of earnings from sales or be sentenced to confiscation of property.
2.Article 1 This Measure is formulated in accordance with the Foreign Trade Law and the Regulations Governing Import and Export Of Goods for purpose 0f reasonably allocating resources,normalizing the order 0f export businesses,creating an open and fair trade environment, executing the international conventions and treaties to which China is bound and safeguarding the national economic interests and security.
3.The main purposes of the Shanghai Cooperation Organization are: strengthening mutual trust and good-neighborly relations among member states; promoting their effective cooperation in political affairs, economy and trade, scientific-technical, cultural, and educational spheres as well as in energy, transportation, tourism, and environment protection fields; joint safeguarding and presenting regional peace, security and stability; striving towards creation of democratic, just, reasonable new international political and economic order.
